Policies
By using Quokka Solutions’ services, you acknowledge, understand, and agree to our policies. You also agree to pay all fees billed to you. Quokka Solutions reserves the right to change its policies or fees at any time without notification. All changes are effective immediately.
Account Suspension
Any accounts with an unpaid balance will be suspended without notice. We offer a 1 month grace period before suspending an account due to non-payment. This 1 month period begins when the oldest, unpaid invoice was billed. During account suspension, all services will be halted and no support requests will be answered. To reinstate your account, you must pay all outstanding invoices in full, plus any applicable fees. If you request to close your account with us, you will still be liable for all outstanding invoices and applicable fees.
Cancellation
You will still be liable for all outstanding invoices and applicable fees, even if your account is suspended or cancelled.
To cancel services with us, you must complete our Maintenance Plan form. You must complete the form for each account you wish to cancel.
An account will be cancelled, effective immediately, if the account has been suspended three or more times within one year. We will not issue a refund for any amount paid, and you will still be liable for all outstanding invoices and applicable fees.
We reserve the right to discontinue services or cancel an account for any reason, at any time, without notice.
Client Responsibilities
You are responsible for ensuring that the website’s content complies with all applicable local, state, federal, and international laws and regulations.
You are responsible for securing the appropriate license(s) to use all creative content featured on the website (creative content includes, but is not limited to, pictures, videos, logos, music, and so forth).
You are responsible for providing Quokka Solutions information necessary to complete the project. This information includes, but is not limited to, your website’s text, images, videos, your logo, etc. Unless otherwise agreed upon, information should be provided within one week of Quokka Solution’s request for information.
You understand that Quokka Solutions is not your employee. Quokka Solutions reserves the right to use independent contractors in connection with any project.
Upon project completion, you accept the website “as is” with all faults, and assume all responsibility for the website. This includes, but is not limited to, website maintenance, website security, DNS, and website hosting.
Credits and Portfolio
Quokka Solutions reserves the right to be credited, or take credit, for all work. We also reserve the right to display the work in our portfolio, website, social media, print, and other publications.
Enforceability
If any provisions of these policies are determined to be illegal, invalid, or otherwise inoperative, then the remaining provisions will remain fully effective, valid, and operative.
These policies will be interpreted, governed, and enforced under the laws of the State of Oklahoma of the United States of America
Intellectual Property
For the purposes of these policies, “intellectual property” includes, but is not limited to, websites, logos, pictures, music, videos, source files, concepts, creative works, inventions, patents, trademarks, copyrights, preliminary works, written works, drafts, processes, discoveries, improvements, and so forth.
Quokka Solutions reserves all intellectual property rights including, but not limited to, copyright, beta website design, preliminary works, concepts, sources files, original artwork, designer tools, layouts, wire-frames, and so forth.
All intellectual property created or owned by Quokka Solutions is the sole property of Quokka Solutions.
All intellectual property created or owned by any third party is the sole property of the respective third party.
Late Fees
A late fee of 10% of the outstanding balance or $1.00 (whichever amount is greater) will be charged for any outstanding balances. Unpaid late fees may also incur late fees.
